1. who we are

DontFumble is an AI-assisted conversation coaching product accessible at dontfumble.online, operated by the team behind the brand "DontFumble". notices, questions, or legal correspondence: dontfumbleai@gmail.com.

2. eligibility

you must be at least 16 years old to use DontFumble. if you're between 16 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed these terms. the service is not intended for users under 16, and we will delete any account we learn belongs to a minor under 16.

3. your account

• you're responsible for the security of your login credentials and for everything that happens on your account.
• you must provide accurate information when signing up and keep it up to date.
• one human, one account. don't create or operate accounts on behalf of others without their explicit consent.
• you may delete your account at any time by emailing dontfumbleai@gmail.com.

4. acceptable use

you agree to use DontFumble lawfully and respectfully. you will not use the service in any way that violates applicable law, infringes anyone's rights, or that we reasonably determine is abusive. specifically, you agree NOT to:

• impersonate another person in a manner intended to deceive.
• upload screenshots, files, or other content that you do not have the right to share — including private medical or financial records of others, leaked corporate communications you're not authorized to disclose, or material that infringes someone's copyright, trademark, or right to privacy.
• attempt to reverse-engineer, scrape, or extract our prompts, model outputs, or underlying systems for the purpose of building a competing service.
• abuse the service through excessive automated requests, exploiting payment flows, or evading rate limits.
• introduce malware, attempt to gain unauthorized access to other accounts, or interfere with the integrity of the service.

we reserve the right to suspend or terminate accounts that violate these rules or applicable law, with or without notice depending on severity.

5. AI-generated content — important

DontFumble produces suggestions using third-party large language models (currently Anthropic's Claude). these are suggestions, not advice. you alone are responsible for what you choose to send to other people. specifically:

• AI output can be wrong, awkward, or read your situation incorrectly. read every suggestion before sending.
• DontFumble is not a therapist, doctor, lawyer, financial advisor, or licensed counselor. nothing the AI produces is professional advice in any regulated domain.
• if you're in crisis (self-harm, abuse, emergencies), please contact a qualified professional or local emergency services. do not rely on DontFumble for those situations.
• DontFumble does not guarantee any outcome in your real-world conversations, relationships, negotiations, or business interactions.

6. content you upload

you retain ownership of the messages, screenshots, and files you upload (your "content"). you grant DontFumble a limited, worldwide, royalty-free license to store, process, transmit, and display your content solely to operate the service for you (e.g. send it to our AI provider to generate a reply, store it so you can revisit the chat, build per-chat memory). this license terminates when you delete the content or your account.

we do not sell your content. we do not use your content to train AI models. see our Privacy Policy for full detail.

7. paid plans & payments

• paid plans (currently Pro and Elite) are processed through Razorpay in INR or USD.
• plans are one-time purchases for a fixed period of access — they do not auto-renew unless explicitly stated at checkout.
• prices, features, and limits may change. changes do not affect a purchase already made for its committed period.
• payment failures, chargebacks, or fraud attempts may result in account suspension.
• refunds: see our Refund & Cancellation Policy.

8. service availability

we work hard to keep DontFumble up, but we make no uptime guarantee. third-party outages (Supabase, our AI provider, Razorpay, your internet) can interrupt the service. we are not liable for losses arising from downtime, slowdowns, or feature changes.

9. third-party services

DontFumble integrates with third-party providers (Anthropic for AI, Supabase for data & auth, Razorpay for payments, Google for optional sign-in). your use of those providers is also governed by their own terms. we are not responsible for the acts, omissions, or policies of those third parties.

10. intellectual property

the DontFumble name, logo, design, prompts, code, and all related materials are owned by DontFumble or its licensors and are protected by intellectual property laws. these terms grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the service — they do not transfer ownership of anything beyond your own content.

11. copyright / takedown

if you believe content on DontFumble infringes your copyright or other rights, email dontfumbleai@gmail.com with: (a) identification of the work, (b) the location of the infringing material, (c) your contact info, (d) a good-faith statement that the use is unauthorized, and (e) a statement under penalty of perjury that your notice is accurate. we will investigate promptly and may remove the content and/or terminate repeat infringer accounts.

12. termination

you can stop using DontFumble and delete your account at any time. we may suspend or terminate your account if you violate these terms, if your payment fails or is reversed, or if continued service exposes us to legal risk. on termination, your data is handled per our Privacy Policy. sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution) will survive.

13. disclaimers

the service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy of AI output. DontFumble does not guarantee that the service will be uninterrupted, error-free, or secure.

14. limitation of liability

to the maximum extent permitted by law, DontFumble and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or social / relational outcomes, arising from your use of the service. our total cumulative liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. some jurisdictions don't allow the exclusion of certain damages — in those jurisdictions, our liability is limited to the maximum extent permitted by law.

15. indemnification

you agree to defend, indemnify, and hold harmless DontFumble and its operators, contractors, and affiliates from any third-party claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of: (a) your content, (b) your use of the service, (c) your violation of these terms, or (d) your violation of any applicable law or the rights of any third party (including the people you message or screenshot). we may, at our option, assume the defense of any such matter at your expense.

16. force majeure

DontFumble is not liable for any failure or delay caused by events outside our reasonable control, including acts of nature, war, terrorism, civil unrest, government action, pandemics, network outages, third-party service failures, or labor disputes.

17. governing law & disputes

these terms are governed by the laws of India, without regard to conflict-of-laws rules. you and DontFumble submit to the exclusive jurisdiction of the courts at our registered place of business for any dispute, except where local consumer protection law gives you the right to bring proceedings locally. before bringing a formal claim, please email dontfumbleai@gmail.com so we have a chance to resolve the issue informally.

18. severability, waiver & entire agreement

• severability: if any clause of these terms is held invalid or unenforceable, the remaining clauses remain in full effect, and the invalid clause is replaced with one that comes closest to the original intent.
• no waiver: our failure to enforce any right or provision is not a waiver of that right or provision.
• entire agreement: these terms, our Privacy Policy, our Refund & Cancellation Policy, and our Cookie Notice together form the entire agreement between you and DontFumble and supersede any prior agreements or understandings.
• no assignment by you: you may not assign or transfer these terms or your account without our prior written consent. we may assign these terms in connection with a merger, acquisition, or sale of assets.

19. changes to these terms

we may update these terms from time to time. material changes will be posted on this page with a new "effective" date and, where reasonable, surfaced in-app. continued use after a change means you accept the updated terms.
